Pune, 28th February 2025: In a shocking turn of events at the Swargate bus depot rape case trial, defence lawyers Adv Wajid Khan and Adv Sajid Shah have made a bold claim that the alleged rape was consensual. Representing the accused Dattatray Gade, they argued in court that there was no force involved and both parties had agreed to the act.

The defence team pointed out that the victim did not cry out for help during the incident, leading them to believe that it was not a case of rape. They firmly stated, “It was done with consent.”

Despite this argument, the court decided to keep Gade in police custody until 12th March, pending further investigation into the case.

Gade, a 37-year-old with a history of criminal activities, was apprehended after a rigorous 75-hour search operation. The alleged assault took place on 25th February inside a bus at Swargate Bus Depot, just a stone’s throw away from the Swargate Police Station.

After being on the run, Gade was finally captured in Shirur Taluka, in his hometown. The police used drones and sniffer dogs to track him down, leading to his arrest in Gunat village.

The defence’s argument of consent directly contradicts the victim’s statement to the police. According to her, Gade approached her at the bus station, referred to her as “sister,” and then forced her into an empty bus where the assault occurred. Gade, however, denied the allegations and claimed that the act was consensual during police interrogation.

The case has stirred up public outrage and calls for increased safety measures in the area, as the community grapples with the disturbing incident.
