The legal battle over the name “Burger King” in Pune has taken an interesting turn, catching the attention of many. The local burger shop in Pune’s Camp area has been locked in a dispute with the international fast-food giant, Burger King. The recent ruling by the Pune Court favored the local burger shop, allowing them to continue using the name. However, the matter has now moved to the Bombay High Court, where a temporary ban has been placed on the Pune restaurant’s use of the name until a hearing on 6th September.

The feud dates back to 2011 when Burger King Corporation from the USA filed a lawsuit against the Pune-based restaurant owned by Anahita and Shapoor Irani, an Iranian couple. The US company argued that the use of the name “Burger King” infringed on their trademark and sought to stop the couple from using it. The couple defended themselves by stating that they had been using the name since 1992, long before Burger King entered the Indian market.

The Iranian couple also filed a counterclaim for damages, alleging that Burger King’s legal actions had harmed their business. Despite Burger King’s global presence, with the trademark registered in 1954, the Pune court ruled in favor of the local restaurant. The judge noted that the local restaurant had been using the name before the American chain established itself in India in 2014.

Following the Pune court’s decision, Burger King has challenged the ruling in the Bombay High Court, leading to the temporary ban on the Pune restaurant’s use of the name. The legal battle continues to unfold, with many eagerly awaiting the outcome of the next hearing.
