The defence attorney for the 17-year-old driver involved in the tragic accident is not backing down. He’s contesting the prosecution’s request to try the teenager as an adult, claiming that it goes against Supreme Court guidelines.

The lawyer, Prashant Patil, has filed an application with the Juvenile Justice Board, emphasizing that the Supreme Court’s ruling in the Shilpa Mittal vs. State of Delhi case clearly states that charging a minor under section 304 of the Indian Penal Code does not constitute a heinous offence. He’s also arguing that the state has not followed the proper procedures outlined in the Juvenile Justice (Care and Protection) Act, 2015.

Patil has requested the JJB to give him a month to meet with the minor, gather instructions, and prepare a response to the prosecution’s plea for trying the teenager as an adult. The hearing has been postponed until September 26 to consider these requests and the prosecution’s plea.

Assistant Commissioner of Police Ganesh Ingale, who is leading the investigation, has also asked for more time to respond to the defence’s applications. He mentioned that a supplementary chargesheet would be filed soon as the investigation continues. The tragic incident took place in May when the teenager, son of a local builder, was driving the Porsche and collided with a motorcycle, resulting in the death of two young software engineers.

Patil has highlighted the importance of conducting a preliminary assessment of the minor’s mental and physical capacity to commit the offence, understanding of the consequences, and the circumstances surrounding the incident as per the Juvenile Justice Act. This assessment should be completed within three months of the minor’s first appearance before the JJB.
