1. Deputy Registrar Disqualifies Society Committee Members for Financial Irregularities

    In a shocking turn of events on April 5, 2024, the Deputy Registrar has disqualified the chairman, secretary, and treasurer of a society for failing to provide financial information to its members for nearly two years. Despite a magistrate’s order, the committee did not submit the required documents, leading to their disqualification under Section 154 b/8 (2) & (23). An appeal to the Joint Registrar was also rejected, solidifying the decision for a five-year ban.

    The disqualified committee members were accused of manipulating members’ rights to information, falsifying monthly proceedings, and installing lifts without proper approvals. One committee member even allegedly forged signatures for attendance while residing abroad. Financial discrepancies, including skipping audits and concealing accidents, were also brought to light. Their dismissive attitude towards member concerns and use of threats were cited as reasons for their disqualification.

    Complainants Prajakta Pethkar and Shalini Noronha played a crucial role in ensuring the submission of evidence against the committee’s violations. With the support of over 200 members, they worked tirelessly to bring the case to light.   4. Plans to Form a Cooperative Council

    Following the disqualification of the committee, the complainants plan to form a cooperative council to assist other societies facing similar issues with their management committees. By sharing their experiences and lessons learned, they hope to prevent future instances of misconduct. This landmark case sets a legal precedent in Maharashtra, being the first of its kind to disqualify an entire society committee under Section 78.

  5. Banned from Holding Positions for Five Years

    The disqualified members are prohibited from holding any position in the society’s management for the next five years, starting from March 13, 2024. This decision marks a significant step towards ensuring accountability and transparency within society management committees.
