Have you ever wondered what happens after a tragic accident on the highway? Well, in a recent case on the Pune-Mumbai highway near Kamshet Ghat, the Motor Accident Claims Tribunal (MACT) has directed Go Digit General Insurance Limited to pay a hefty sum of ₹2.65 crore as compensation to the family of a technical manager who lost his life in a devastating accident.
The incident took place on January 29, 2023, when the manager was on his way from Khopoli to Pune. A trailer truck overturned after hitting a divider and struck the 42-year-old, causing critical injuries that unfortunately led to his demise on February 1.
Following the accident, the truck driver faced charges of causing death due to negligence under the Indian Penal Code and relevant sections of the Motor Vehicles Act. While the criminal case against the driver is still pending, the victim’s wife, daughter, and elderly parents sought compensation of ₹5 crore under Section 166 of the Motor Vehicles Act.
However, in a recent development, the matter was resolved amicably between the applicants and the insurance company. The insurance company’s representative, Advocate Sunil Dravid, mentioned that the strong evidence against the truck driver and the lack of statutory defenses led to an encouraged settlement. The settlement amount of ₹2.65 crore was determined based on the victim’s age and last drawn income.
The tribunal’s decision on January 9, 2025, directed the insurance company to pay the compensation to the claimants within a month of issuing the compromise decree on January 13. This case serves as a reminder of the importance of road safety and the legal repercussions of negligence on the road.
