Founded in 1954, the American Burger King Corporation has grown into a global fast-food chain with thousands of branches worldwide. They entered the Indian market in 2014, only to find out in 2008 that a restaurant in Pune was already using the same name.
Despite attempts to settle the matter amicably, Pune’s Burger King stood their ground and the case went to court. In a landmark ruling, District Judge Vedpathak acknowledged that Pune’s Burger King had been using the name and trademark long before the American corporation registered it in India.
The court emphasized the consistent service provided by Pune’s Burger King over the years, with their legal team effectively arguing for the local joint’s right to continue operating under the same name.
